First-Offense OWI Penalties in Iowa

Under Iowa Code 321J.2, a first-offense OWI is classified as a serious misdemeanor. A conviction carries a minimum of 48 hours and a maximum of one year in jail, fines between $625 and $1,250 plus surcharges and court costs, and a driver’s license revocation of 180 days to one year. Iowa OWI convictions can’t be expunged from your criminal record. The Iowa DOT also requires SR-22 insurance proof for two years from the first day of revocation as a condition of reinstatement.

If your BAC was below 0.15% and you submitted to chemical testing, you may be eligible for a Temporary Restricted License (TRL) during the revocation period by installing an ignition interlock device (IID) on all vehicles you drive. A BAC of 0.15% or higher triggers enhanced IID requirements and affects TRL eligibility.

The Deferred Judgment Option

Iowa law offers a deferred judgment for qualifying first offenders. Under this arrangement, the court doesn’t enter a final conviction. If you complete probation conditions successfully, the charge is dismissed. To be eligible, you generally must have submitted to chemical testing, have no prior OWI convictions or prior OWI deferred judgments of any kind, have had a BAC below 0.15%, and the offense must not have caused bodily injury. This is a one-time option under Iowa law, and whether you qualify depends entirely on the facts of your case.

Two Simultaneous Proceedings After an OWI Arrest in Sioux City

When you’re arrested for OWI in Sioux City, the criminal case in Woodbury County District Court is only one front. The Iowa DOT begins a separate administrative proceeding that can revoke your driving privileges independently of the criminal outcome.

The 10-Day DOT Appeal Window

You have 10 days from receipt of the OWI Implied Consent Form to file a written appeal. Miss that deadline and the revocation takes effect automatically. Iowa’s implied consent law means that holding a driver’s license constitutes agreement to submit to chemical testing when lawfully stopped. Refusing a chemical test results in a one-year license revocation for a first offense, compared to 180 days for a first offender who submits and is convicted. A first-offense refusal also bars you from a Temporary Restricted License for the first 90 days.

The Criminal Court Process

After an OWI arrest, you may be cited and released or held for bail. The first court appearance is the formal reading of charges and entry of a plea. Being charged doesn’t mean being convicted. The state must prove every element of the OWI charge beyond a reasonable doubt.
