Goodman Law Firm Woodbury DUI Defense Defending Drivers Throughout Iowa

DUI Attorney in Woodbury County

DUI-Exclusive Defense for Woodbury County Drivers, From Arrest Through Trial

A DUI charge in Iowa doesn’t have to end in conviction. What happens in the days immediately after an arrest, before most people have even called an attorney, can shape the entire outcome. I’m Bryan Goodman, and I’ve spent 17 years defending clients against DUI and OWI charges throughout Woodbury County and the surrounding region from my Sioux City office. DUI defense is the only practice area I handle.

Iowa officially calls this offense Operating While Intoxicated (OWI), though most people search for it as DUI or DWI. Whatever the label, the legal system moves fast. From the moment you’re served notice by the arresting officer, you have 10 days to appeal your license revocation with the Iowa Department of Transportation. This deadline runs separate from and ahead of the criminal case. If that window closes, your driving privileges are gone before the court has heard a word of your defense. If you’ve been arrested for drunk driving in Woodbury County, call (712) 373-2621 now.

Iowa OWI Penalties: What a Charge in Woodbury County Can Mean

Iowa’s OWI statute sets thresholds at 0.08% BAC for most drivers, 0.04% for commercial license holders, and zero tolerance for anyone under 21. Penalties climb sharply with each offense, and Iowa’s 12-year lookback period means a conviction from a decade ago can still count against you today.

Offense tiers under Iowa law:

  • First Offense (serious misdemeanor): Mandatory minimum 48 hours in jail, up to one year, fines up to $1,250, and license revocation of 180 days to one year
  • Second Offense (aggravated misdemeanor): Mandatory minimum seven days in jail, up to two years, fines of $1,875 to $6,250, and license revocation of one to two years
  • Third and Subsequent Offense (Class D felony): Mandatory minimum 30 days in jail, up to five years, fines of $3,125 to $9,375, and a six-year license revocation

Convictions at any level can also bring ignition interlock device requirements, mandatory substance abuse evaluation and treatment, and insurance premium increases that follow a driver for years. OWI charges aren’t limited to alcohol, either. Iowa’s statute covers impairment from illegal drugs, prescription medications, or any substance affecting the ability to operate a vehicle.

How DUI Cases Move Through Woodbury County District Court

OWI cases in Woodbury County are handled by the Woodbury County District Court, part of Iowa’s 3rd Judicial District, located in Sioux City. I monitor court trends and procedures here continuously, because how a judge or prosecutor approaches a particular evidentiary issue in this courthouse isn’t always what the statute alone would suggest.

Two Parallel Tracks After an OWI Arrest

An OWI arrest in Woodbury County opens two simultaneous processes. The criminal case moves from initial appearance through arraignment, pre-trial motions, and potentially trial. The Iowa DOT administrative process runs on its own timeline and can revoke your license before the criminal case is anywhere near resolved. Both tracks require attention from the start, and neither waits for the other.

Why Pre-Trial Motions Matter

Pre-trial motions are often where the most important work happens. This is the stage where I can challenge whether the traffic stop was legally justified, whether field sobriety tests were administered correctly, or whether breathalyzer results should be suppressed. A successful motion can significantly narrow what the prosecution is allowed to present. In some cases, it may end the case entirely.

Why Breathalyzer Results & Field Sobriety Tests Can Be Challenged

One of the most common misconceptions about DUI cases is that a positive breath test or a failed field sobriety test settles the matter. It doesn’t. Both types of evidence are vulnerable to challenge when the facts support it.

Instructor-Level Training in the Tests Used Against You

I completed the same 32-hour NHTSA DWI Detection and Standardized Field Sobriety Testing Instructor course that law enforcement officers are required to pass, which qualifies me to teach it. That training means I evaluate field sobriety test administration the same way a certified instructor would, and I know exactly where officers deviate from required protocol. I’ve also completed the Advanced Roadside Impaired Driving Enforcement (ARIDE) program and the 24-Hour Overview of the Drug Recognition Expert (DRE) course, both developed by NHTSA for law enforcement, and I’ve trained specifically on the Datamaster DMT breathalyzer, including its underlying science, data output, and defense applications.

What This Means for Your Case

I review the arresting officer’s training records and administration of each test. I request Datamaster DMT calibration logs and maintenance records. I examine whether Iowa’s implied consent procedures were followed correctly, because a deviation there affects the admissibility of chemical test results. Physical conditions, environmental factors, mouth alcohol, and equipment calibration errors can all produce inaccurate readings, but identifying those problems requires knowing exactly what to look for.

A DUI-Exclusive Practice Means a Different Level of Defense

Most criminal defense attorneys handle DUI as one case type among many. I handle nothing else. Every hour of training I’ve completed, every court trend I track, and every procedural nuance I’ve learned applies directly to the cases I take on in Woodbury County.

Goodman Law Firm represents that I am the only attorney in the Sioux City area who has earned the certified DWI Detection and Standardized Sobriety Testing Instructor credential. That designation doesn’t just reflect classroom hours. It reflects a depth of understanding of how these tests are supposed to work and how they fail. That goes beyond what most prosecutors and many law enforcement officers bring to a given case.

I’m a member of the National College for DUI Defense (NCDD) and the National Association of Criminal Defense Lawyers (NACDL). I received the Forensic Science and Trial Skills Award from the NCDD, an honor given to very few DUI attorneys in the country. When a case warrants it, I’m prepared to take it to a jury. Negotiated outcomes are sometimes the right result, but I build every defense as if trial is where it ends.
